These Terms & Conditions apply to purchases made through the YARD ETC online shop at yardetc.com operated by Yard ETC AB.
Please read these Terms before placing an order. By placing an order, you agree to these Terms & Conditions.
Nothing in these Terms limits any mandatory consumer rights that apply to you under the law of your country of residence.
1. About YARD ETC
The online shop is operated by:
Yard ETC AB
Company registration number: 556967-8282
Olofsdalsvägen 27
302 41 Halmstad
Sweden
Email: info@yardetc.com
In these Terms, “YARD ETC”, “we”, “us” and “our” refer to Yard ETC AB.
2. Products
YARD ETC sells personal-care products, home fragrance, cleaning products, gardening and planting products, garments and other products presented in the online shop.
We make reasonable efforts to ensure that product descriptions, photographs, colours, dimensions, ingredients, materials and other information are accurate.
Natural products and materials may vary slightly in appearance.
Photographs are intended to illustrate the products and may not always represent the exact size, colour or appearance of an individual item.
Where a product has specific instructions, warnings, ingredients, materials or safety information, these should be read before use.
Nothing in a product description limits your statutory rights if a product does not conform to the contract.
3. Prices and VAT
All consumer prices shown in the online shop include applicable VAT unless otherwise stated.
The applicable price is the price displayed at the time you place your order.
The currency and price shown to you may depend on your delivery country and the settings of the online shop.
Any applicable delivery charges will be shown separately before you place your order.
The final total, including applicable VAT and delivery charges, will be shown before you submit your order.
Discounted products have the same statutory consumer rights as products sold at their ordinary price.
4. Ordering
You place an order by completing the checkout process and clicking the final order button.
Before submitting your order, you will be able to review:
- the products and quantities;
- the product prices;
- applicable VAT;
- delivery charges;
- your delivery information;
- the selected payment method; and
- the total amount payable.
The final order button clearly indicates that placing the order creates an obligation to pay.
After submitting your order, we will send an order confirmation to the email address provided at checkout.
If we cannot accept your order, for example because a product is unavailable or there is an obvious pricing or technical error, we will inform you as soon as reasonably possible and refund any payment already made.
5. Availability
We aim to keep product availability information up to date.
If a product becomes unavailable after you place an order, we will contact you as soon as reasonably possible.
Where appropriate, you may choose to:
- wait for the product;
- choose an alternative product; or
- cancel the affected part of the order.
If we cancel an order or part of an order because a product is unavailable, any payment relating to that product will be refunded.
6. Payment
The payment methods available to you are shown during checkout and may vary depending on your country.
Payment methods may include card payment, Klarna, Link, Apple Pay, Google Pay, Amazon Pay or other payment services.
Payment may be processed by an independent payment provider.
The relevant payment provider may process personal data for payment processing, authentication, fraud prevention, security, credit assessment or other purposes according to its own terms and privacy information.
YARD ETC does not store complete card payment details where payment is processed directly by a third-party payment provider.
7. Delivery
We currently deliver to the countries available for selection during checkout.
The available delivery method, delivery charge and estimated delivery time are shown during checkout.
Delivery charges may vary according to the destination country, order value, weight or other factors.
The delivery information shown at checkout is the delivery information applicable to your order.
Unless a different delivery period has been agreed with you, applicable consumer law generally requires delivery without undue delay and, as a general rule, within 30 days.
If we expect a significant delay, we will inform you.
If a delay gives you a statutory right to cancel your order, you may exercise that right.
8. Delivery and responsibility for the goods
For consumer purchases, YARD ETC remains responsible for the goods until they are physically received by you or by a person you have designated, unless you independently arrange a carrier that was not offered by YARD ETC.
If a parcel appears damaged when delivered, please notify the carrier and contact us as soon as reasonably possible and, where possible, take photographs of the packaging and the product.
You do not lose any statutory rights simply because a carrier’s delivery procedure has been followed.
9. Unclaimed deliveries
If you do not collect or accept a delivery, please contact us as soon as possible.
Where permitted by applicable law, we may charge reasonable costs resulting from an unclaimed delivery if those costs and the relevant conditions were clearly communicated before purchase.
This does not affect your statutory right to withdraw from an online purchase.
10. Right of withdrawal
If you are a consumer purchasing goods online, you generally have a statutory right to withdraw from your purchase within 14 days without giving a reason.
For goods, the withdrawal period generally begins when you, or a person designated by you other than the carrier, receives the goods.
If an order is delivered in several separate consignments, the withdrawal period may begin when you receive the final product or consignment, as provided by applicable law.
You may also notify us of your withdrawal before receiving the goods.
How to withdraw
You can exercise your right of withdrawal:
- through the YARD ETC online Returns & Withdrawals function;
- by email to info@yardetc.com; or
- by another clear statement informing us that you wish to withdraw from the purchase.
You do not have to give a reason for withdrawing.
Our online withdrawal function is available through the Website for purchases for which a statutory right of withdrawal applies.
If you use the online withdrawal function, we will provide an acknowledgement of receipt on a durable medium, normally by email.
A standard withdrawal form is also available through our Returns & Withdrawals page.
11. Returning goods
After notifying us that you wish to withdraw, you must return the goods without undue delay and normally no later than 14 days after notifying us.
Unless the goods are defective, or we have agreed otherwise, you are responsible for the direct cost of returning goods where we have informed you of this before purchase.
We recommend that you obtain proof of postage and retain it until your refund has been completed.
Information about the return process is available on our Returns & Withdrawals page.
12. Condition of returned goods
You may handle goods to the extent reasonably necessary to establish their nature, characteristics and functioning, in a manner comparable to what would normally be permitted in a physical shop.
You may therefore need to open ordinary packaging in order to inspect a product.
If you handle or use the goods beyond what is reasonably necessary for such an inspection, you may be responsible for any resulting reduction in value, to the extent permitted by applicable law.
We do not apply a blanket rule that opening a package automatically removes your statutory right of withdrawal.
Sealed products and hygiene
Certain products may be excluded from the statutory right of withdrawal where the legal conditions for such an exception apply.
This may include certain sealed products supplied for health or hygiene reasons where the seal has been broken after delivery.
Where a particular YARD ETC product is subject to such an exception, this will be clearly indicated before purchase.
13. Refunds
If you validly withdraw from your purchase, we will refund the payments received from you in accordance with applicable law.
This normally includes the cost of the least expensive standard delivery option offered by us.
If you selected a more expensive delivery option, we are not required to refund the additional cost.
Refunds will normally be made using the same payment method used for the original purchase, unless otherwise agreed with you and permitted by law.
Where permitted by law, we may wait to make the refund until we have received the returned goods or you have provided evidence that you have sent them back, whichever occurs first.
14. Faulty, damaged or incorrect products
Your statutory consumer rights apply if a product is defective, damaged, incorrect or otherwise does not conform to the contract.
These rights are separate from your statutory right of withdrawal.
If you receive a damaged, defective or incorrect product, please contact:
Please include your order number and, where possible, photographs showing the issue.
We will assess the matter and provide an appropriate remedy in accordance with applicable consumer law.
Depending on the circumstances and the law applicable to your purchase, remedies may include repair, replacement, price reduction or cancellation and refund.
Nothing in these Terms limits your statutory rights.
15. Complaints and legal guarantee
Consumers have statutory rights concerning defective or non-conforming products.
For purchases governed by Swedish consumer law, YARD ETC is generally responsible for original defects for three years from the date of sale. A complaint made within two months of discovering a defect is always considered to have been made within a reasonable time under Swedish law.
Other countries may provide mandatory consumer rights that apply to consumers resident there.
These statutory rights are not affected by any commercial warranty that YARD ETC may offer.
16. Exchanges
If you would like to change a size, colour or product, please contact us.
Where appropriate, we may offer an exchange as a service to customers.
An exchange policy offered voluntarily by YARD ETC does not replace or restrict your statutory right of withdrawal or your rights concerning defective products.
17. Product information and safe use
Please follow all instructions, warnings, storage recommendations and other information supplied with a product.
This is particularly important for cosmetics, personal-care products, cleaning products, home fragrance products and gardening products.
If you have an allergy, sensitivity or other concern about an ingredient or material, please contact us before using the product.
18. Marketing communications
We may send communications necessary to administer your order, including order confirmations, delivery information, payment information and return information.
Marketing communications will be sent in accordance with applicable law.
You can unsubscribe from marketing communications at any time using the unsubscribe link included in the communication or by contacting us.
Unsubscribing from marketing communications does not prevent us from sending communications necessary to administer an existing order.
19. Intellectual property
The YARD ETC name, logo, photographs, designs, text, graphics and other content on the Website are owned by or licensed to YARD ETC.
They may not be copied, reproduced or commercially used without our prior written permission, except where permitted by law.
20. Website information and technical errors
We make reasonable efforts to keep the Website accurate and available.
Temporary interruptions may occur because of maintenance, technical problems, security issues or circumstances outside our control.
If an obvious technical or pricing error occurs, we reserve the right to correct it, subject to applicable consumer law.
21. Events beyond our reasonable control
We are not responsible for delays or failures caused by circumstances beyond our reasonable control, to the extent permitted by applicable law.
This may include natural disasters, war, government restrictions, major infrastructure failures, strikes, pandemics, cyber incidents or significant failures affecting suppliers or carriers.
This section does not limit statutory consumer rights.
22. Applicable law and consumer rights
These Terms are governed by Swedish law, subject to any mandatory consumer protection rules that apply in the country where you habitually reside.
A choice of Swedish law does not deprive a consumer of mandatory rights available under the law applicable to that consumer.
Nothing in these Terms prevents you from exercising rights before the courts or consumer dispute-resolution bodies available to you under applicable law.
23. Changes to these Terms
We may update these Terms when our business, Website or legal requirements change.
The version applicable to your purchase is the version available when you place your order, unless a change is required by law or otherwise agreed with you.
